01Agreement to these terms

By visiting persivamethod.com or thepersivamethod.com, creating an account, or purchasing any product, you agree to be bound by these Terms of Service. If you do not agree, do not use this website or purchase any product.

These Terms constitute a legally binding agreement between you and PCR Consulting, LLC DBA Persiva (“Persiva,” “we,” “us,” or “our”). We may update these Terms at any time. Continued use of the site or any Persiva product after an update constitutes acceptance of the revised Terms.

02 Eligibility

To purchase from Persiva, you must:

• Be at least 18 years of age.
• Be a resident of the United States.
• Have the legal authority to enter into a binding contract.
• Provide accurate, complete information at checkout.

Persiva products are sold exclusively to buyers located in the United States. We do not process orders from buyers outside the United States.

03 Products and digital delivery

The Persiva Method is a downloadable digital product bundle. Upon completed payment, you will receive access to your purchased files via a secure download link delivered to the email address provided at checkout.

It is your responsibility to provide an accurate email address at checkout. Persiva is not responsible for delivery failures caused by an incorrect email address, a full inbox, or overzealous spam filters.

If you experience a verified technical failure in delivery caused by Persiva, contact us at support@persivamethod.com within 72 hours of purchase. We will investigate and re-deliver your files at no charge.

All product descriptions on persivamethod.com represent the contents of each tier at the time of purchase. Persiva reserves the right to update, revise, or expand product contents at any time. Existing buyers are not entitled to upgrades unless explicitly offered.

04 Pricing and payment

All prices are listed in United States dollars. Persiva processes payments through Stripe and PayPal. By completing a purchase, you authorize the applicable payment processor to charge your selected payment method for the total amount due.

Persiva does not store your credit card number, CVV, or full payment credentials. Payment data is handled exclusively by Stripe and PayPal under their respective terms and security standards.

Prices are subject to change at any time without notice. The price displayed at the time you complete your purchase is the price you will be charged.

05 Refund policy

All sales are final. Because Persiva products are delivered digitally and are immediately accessible upon purchase, we do not offer refunds as a standard practice.

Limited exception: If you contact us at support@persivamethod.com within 72 hours of your purchase date and you have not downloaded any files associated with your order, we will review your request and, at our sole discretion, may issue a full refund. Once any file in your order has been downloaded, no refund will be issued under any circumstances.

If you experience a technical delivery failure caused by Persiva, we will re-deliver your files. A re-delivery does not constitute a refund and does not reset the 72-hour refund window.

Chargebacks initiated outside this policy will be disputed. Evidence of purchase, delivery, and these Terms will be submitted to the applicable payment processor.

06 License and intellectual property

Upon purchase, Persiva grants you a limited, non-exclusive, non-transferable personal use license to access and use the purchased materials for your own internal business purposes. The scope of permitted use is defined by the tier you purchased, as described in the license terms included in every Persiva deliverable.

Regardless of tier, the following are prohibited for all buyers:

• Reselling, sublicensing, or redistributing any Persiva Method material as your own product or as part of a competing product.
• Removing, obscuring, or altering any Persiva copyright notice, trademark, or attribution.
• Sharing download links, login credentials, or file copies with individuals who have not purchased their own Persiva license.
• Publishing or distributing Persiva Method materials on any platform, marketplace, or file-sharing service.
• Using Persiva Method content to train, fine-tune, or develop artificial intelligence models or AI-powered products.

All content included in The Persiva Method, including but not limited to frameworks, templates, scripts, scorecards, workbooks, training decks, and written guides, is the intellectual property of PCR Consulting, LLC and is protected under United States copyright law (17 U.S.C. section 101 et seq.) and applicable international copyright treaties.

Unauthorized reproduction or distribution of Persiva Method materials may result in civil and criminal penalties and will be prosecuted to the maximum extent permitted by law.

07 Marketing communications

By completing a purchase, you are automatically added to Persiva’s email list. You will receive transactional emails related to your order and periodic product and marketing communications from Persiva via Omnisend.

You may unsubscribe from marketing emails at any time by clicking the unsubscribe link in any Persiva email. Transactional emails related to your purchase cannot be opted out of while your order is active.

08 Prohibited conduct

When using persivamethod.com, you agree not to:

• Attempt to gain unauthorized access to any part of the website or its underlying systems.
• Use automated tools, bots, or scrapers to collect content from the site.
• Submit false, misleading, or fraudulent information at checkout.
• Use the website or any Persiva product for any unlawful purpose.
• Interfere with or disrupt the security, integrity, or performance of the website.

09 Disclaimers

The Persiva Method provides recruiting frameworks, templates, scripts, and operational tools. It does not constitute legal, financial, employment, or human resources legal advice. Results will vary based on your industry, company size, hiring volume, and how consistently you implement the system.

Persiva makes no guarantees regarding specific hiring outcomes, time-to-fill reductions, offer acceptance rates, or other performance metrics. Any benchmarks or statistics referenced in Persiva materials are provided for informational purposes only.

The website and all products are provided “as is” and “as available” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10 Limitation of liability

To the maximum extent permitted by applicable law, PCR Consulting, LLC, its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website or any Persiva product, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from or related to these Terms or any Persiva product will not exceed the amount you paid for the product giving rise to the claim.

11 Dispute resolution and binding arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the Persiva website, or any Persiva product will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

Arbitration will take place in Florida or, at your election, via videoconference. The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

You waive any right to participate in a class action lawsuit or class-wide arbitration against Persiva.

Nothing in this section prevents either party from seeking emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.

12 Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any matter not subject to arbitration under Section 11 will be resolved exclusively in the state or federal courts located in Florida.

13 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14 Entire agreement

These Terms, together with the Privacy Policy at persivamethod.com/privacy, constitute the entire agreement between you and Persiva with respect to your use of this website and any Persiva product. They supersede all prior agreements, representations, or understandings, whether written or oral.
